就在上星期川普威脅要 Tiktok 美國部分被出售之後，今天（8月6日），川普突然引用國際緊急經濟權力法（International Emergency Economic Powers Act）發出了兩份行政令，一份針對騰訊的微信，一份針對 Tiktok。我們在美國還能繼續使用微信嗎？接下來筆者就來分析一下。

行政令

  1. 微信：Executive Order on Addressing the Threat Posed by WeChat
  2. Tiktok: Executive Order on Addressing the Threat Posed by TikTok

美國人士（US Persons）

在該行政令中，「美國人士」被定義為：

  • 美國公民；
  • 美國永久居民；
  • 根據美國法律成立的機構；和
  • 身在美國的人

行政令限制條款

以下是微信版本的行政令，Tiktok 的非常類似：

Section 1. (a) The following actions shall be prohibited beginning 45 days after the date of this order, to the extent permitted under applicable law: any transaction that is related to WeChat by any person, or with respect to any property, subject to the jurisdiction of the United States, with Tencent Holdings Ltd. (a.k.a. Téngxùn Kònggǔ Yǒuxiàn Gōngsī) , Shenzhen, China, or any subsidiary of that entity, as identified by the Secretary of Commerce (Secretary) under section 1 (c) of this order.

(c) 45 days after the date of this order, the Secretary shall identify the transactions subject to subsection (a) of this section.


行政令禁止任何「美國人士」與騰訊控股有限公司和其任何分支（不只是微信！）做任何「交易」(transaction)，這裡的交易可以根據國際緊急經濟權力法（IEEPA）作廣義的解讀，並不只限於涉及金錢的交易。但使用 App 聊天本身不太可能被納入「交易」的範疇，因為 IEEPA 豁免了任何沒有實體價值轉移的純通訊：
The authority granted to the President by this section does not include the authority to regulate or prohibit, directly or indirectly—

(1) any postal, telegraphic, telephonic, or other personal communication, which does not involve a transfer of anything of value;

微信還能不能用？怎麼跟內地繼續溝通？

雖然法律上可能這個行政令不會直接達成禁止聊天的效力，事實上卻很可能會產生微信停止為美國服務的結果。比如騰訊的合作夥伴可能會拒絕提供服務（類似華為剛被加入實體名單時的情況）。

準備備用聊天應用

筆者建議大家考慮提前準備好其他 App，至少有個備用，不會一下子失聯。可以考慮的選項有：Telegram, Signal, What's App 以及 Line。

如果需要跟國內人民保持聯繫的話，筆者推薦 Skype 和 iMessage/Facetime，或者回歸 Email。

微信畢竟是跟國內聯繫的最有效途徑，你也可以考慮準備一個國內的手機號碼來綁定，這樣即使微信停止為美國服務，通常也只是停止給美國手機號服務，中國號碼綁定的微信應該是相對安全的。主要有以下幾種廉價的中國手機號碼辦法：

  • 實體號碼，保號收短訊類的：月租 5-8 元不等，三大電訊營運商都有提供，可以在境外接收短訊

以中國移動為例，有 8 元飛享套餐。開通的時候順便開通下國際漫遊（免費），可以在美國收短訊。

  • 虛擬號碼，綁定於實體號碼上，月費 0-3 元不等，三大電訊營運商都有提供

以中國移動為例，一個實體手機號碼可以申請三個虛擬號碼（多號服務），月費 3 元。短訊電話將會發到實體主卡手機上。你可以讓國內家人（朋友）幫你申請多個號碼，用來綁定微信、支付寶等。尤其適合無法自己回國申請廉價實體號碼的讀者。

行政令的合法性

總統引用的國際緊急經濟權力法（International Emergency Economic Powers Act），廣泛地授權總統在特殊情況下作出這些限制：

(b) The authorities granted to the President by section 1702 of this title may only be exercised to deal with an unusual and extraordinary threat with respect to which a national emergency has been declared for purposes of this chapter and may not be exercised for any other purpose. Any exercise of such authorities to deal with any new threat shall be based on a new declaration of national emergency which must be with respect to such threat.

這項總統的行政令有越權的可能性。另外這項行政令可能也會導致多項憲法權利被侵犯。可以預見如果產生嚴重後果的話，這項行政令的合法性會在法院遭到挑戰。
