About the Settlement
If you bought Deep River-branded potato chips labeled "Non-GMO ingredients" between February 2, 2017, and December 6, 2024, you may be eligible for cash compensation. You can fill out the form for $10 without proof of purchase.
This lawsuit is mainly against Old Lyme Gourmet Co. (Deep River Snacks). The plaintiffs allege that the defendant labeled certain Deep River-branded potato chip products as "Non-GMO ingredients," which could lead consumers to believe these products were certified as non-GMO by a third party (such as the Non-GMO Project). The plaintiffs claim that these products were not third-party certified. Although the defendant denies these allegations, no court ruling has been made yet.
If you purchased the products listed above (Deep River-branded potato chips with a "Non-GMO ingredients" label) in the U.S. for personal or household use, you are a "settlement class member."
Available Cash Compensation
For settlement class members who submit a valid claim form before the deadline, the following amounts are available:
- Valid claims with proof of purchase: If you submit a valid claim with proof of purchase for each product, you can receive $5 for each product, with an additional $0.50 for each additional product.
- Valid claims without proof of purchase: If you submit a valid claim without proof of purchase, you can receive $5 for each product and up to 10 additional products at $0.50 each.
- Claims with and without proof of purchase can be combined. Only one claim form can be submitted per household.

- Enter the number of units purchased and the number with receipts. First item: $5, each additional one: $0.5. Note: if you do not have receipts or similar proof, you can only enter up to 10 items. If you do have receipts, there is no upper limit on this amount.

Legal Rights and Options
In this case, you have the following legal rights and options:
- File a Claim: Deadline is July 28, 2025. The only way to receive cash compensation is to submit a valid claim form.
- Opt Out: Deadline is March 25, 2025. You will not receive cash compensation, but you may preserve your right to bring your own lawsuit against the released parties.
- Object: Deadline is March 25, 2025. You may tell the court that you do not agree with the settlement. If the court approves the settlement, you will still be bound by it, but you may still submit a claim form and receive cash compensation.
- Take No Action: You will not receive cash compensation and will forfeit your legal rights.
