If you or someone in your household had a FuboTV account or used someone else’s Fubo account before May 29, 2025, and lived in the United States or its territories, you may be eligible for a cash payment from this class action settlement.

Case Background
A proposed settlement has been reached in a lawsuit against FuboTV, Inc. and FuboTV Media, Inc. (collectively, the “Defendants”) involving users of the FuboTV streaming service. The lawsuit alleges that the Defendants collected, stored, used, disclosed, or retained personal information in violation of the Video Privacy Protection Act (VPPA). The settlement also covers related claims, including under the California Invasion of Privacy Act (CIPA). The case is titled Burdette et al. v. FuboTV, Inc. et al., Case No. 2024LA001460, and is pending in the Circuit Court of DuPage County, Illinois. The Defendants deny any wrongdoing and deny that they violated the law. The Court has not decided who is right. To avoid the time, expense, and uncertainty of litigation, the parties agreed to settle. The settlement has received preliminary approval from the DuPage County court.
Who Is Eligible
You are a Settlement Class Member if you had a Fubo account or used someone else’s Fubo account before May 29, 2025. If any of your family members also meet this definition, please share this notice with them so they can understand their options as well.
Settlement Details
If the Court approves the settlement, Settlement Class Members who timely submit valid claim forms will share a $3,400,000 cash settlement fund. Each Settlement Class Member who submits a valid claim will receive an equal share of the cash fund after deduction of settlement costs, attorneys’ fees, and service awards. In addition, Settlement Class Members who meet certain California certification requirements will receive 1.1 times the cash payment allocated to Settlement Class Members who do not make that certification. The amount each valid claimant will receive has not yet been determined and depends on several unknown factors, including how many valid claim forms are submitted by the deadline.
Summary of Your Legal Rights and Options
- Submit a Claim Form: Submitting a timely and valid claim form is the only way to receive payment. Claim forms must be submitted online or mailed by September 12, 2025.
- Exclude Yourself: You will not receive any payment, but you will keep your right to sue the Defendants on your own about the legal claims in this case. Requests for exclusion must be mailed or delivered by August 28, 2025.
- Object or Comment: Write to the Court explaining why you do not support the settlement. The deadline to submit an objection is August 28, 2025.
- Attend the Hearing: Ask to speak in Court about why you do not support the proposed settlement or any of its terms. The Final Approval Hearing is scheduled for October 6, 2025, at 9:00 AM.
- Do Nothing: You will not receive any payment from the settlement and will give up your right to sue the Defendants over the issues in this case. To receive cash compensation, you must timely submit a valid claim form.
