About this case

This class action concerns a customer data breach involving Evolve Bank & Trust and is pending under case number MDL No. 2:24-md-03127-SHL-cgc in the U.S. District Court for the Western District of Tennessee. Case background

This lawsuit involves unauthorized access to Evolve's systems during February and May 2024, which exposed information for both personal bank customers and Evolve FinTech customers. Who is an eligible class member?

All individuals in the United States who provided private information to Defendant and whose information was affected by the data breach may be class members. Private information includes names, dates of birth, Social Security numbers, driver's license numbers, bank accounts, and contact information. The following people are excluded:

  • Defendant's board members
  • Government entities
  • The court and its family members and staff
  • Class members who have made a timely and valid request to opt out

Settlement benefits

The settlement provides these benefits to class members:

  • Credit monitoring: Members may choose one year of credit monitoring, including credit monitoring, real-time alerts, and up to $1,000,000 in identity theft insurance, valued at $110 per person per year.
  • Cash payment options: Members may choose one of the following cash options, but not both:
    • Cash Option A - Documented Loss: Submit a claim for up to $3,000 in cash, with proof of reasonable loss required.
    • Cash Option B - Fixed Cash: A fixed cash payment with an estimated amount of $20.

All cash payments will be reduced on a pro rata basis depending on the number of valid claims, so the settlement fund is fully utilized.
