If you are a resident of one of the designated states and have purchased any milk or dairy products since Jan. 1, 2003 (including the present), you may be eligible for a settlement in a class action lawsuit over price fixing. Each person may receive $10-$20 (the amount may vary). Filing online is very easy. Jan. 31 is the application deadline.
Eligibility
So you don’t get to the end of the article only to find it doesn’t apply to you, here is the class definition for this case: any person who, since 2003 to the present, has been or is currently a resident of any of the following states—AZ, CA, KS, MA, MI, MO, NE, NV, NH, OR, SD, TN, VT, WV, or WI—and purchased milk or dairy products (such as cream, cheese, yogurt, etc.). Purchases made for resale do not count.
All consumers who, from 2003 to the present, as residents of [State], indirectly purchased milk and/or other fresh milk products (including cream, half & half, yogurt, cottage cheese, cream cheese, and/or sour cream) for their own use and not for resale.
Case Progress
This case is Edwards v. Nat'l Milk Producers, now pending in the U.S. District Court for the Northern District of California. The case was filed in 2014. Plaintiffs allege that defendants paid certain farms to slaughter their herds and stay out of the dairy business for a year, reducing competition in the dairy industry and increasing the price of milk products for consumers. The court granted class certification in 2014 in September and December. See the 2014/9/14 Court Order and the 2014/12/16 Court Order. The parties to the litigation signed a settlement agreement on Aug. 11, 2016. The defendants, without admitting any allegations, offered a settlement fund of $52,000,000 (attorney fees for plaintiffs will be deducted). The settlement agreement is still awaiting court approval.
